Privacy & Credit Reporting Policy
In this Privacy & Credit Reporting Policy, 'us' 'we' or 'our' means Halytech Pty Ltd (ABN 51 094 853 068) and our related bodies corporate.
This Privacy & Credit Reporting Policy comprises Part A, which sets out our commitment to protecting the privacy of your personal information provided to us, or otherwise collected, used, stored, handled or disclosed by us when providing our products and services (Products) or when otherwise interacting with you in accordance with the Australian Privacy Principles set out in the Privacy Act 1988 (Cth), and Part B, which explains how we handle credit information and credit eligibility information under Part IIIA of the Privacy Act and the Privacy (Credit Reporting) Code 2025.
Part A - Privacy Policy
By using our website and Products, or in providing any personal information to us, you consent to our collection, use, storage, handling and disclosure of your personal information in accordance with this Part A and any other arrangements that apply between us. We may change our Privacy Policy from time to time by publishing changes to it on our website. We encourage you to check our website periodically to ensure that you are aware of our current Privacy Policy.
"Personal information" includes information or an opinion about an individual that is reasonably identifiable. For example, this may include your name, age, gender, postcode and contact details. It may also include financial information, including your credit card information.
1. What personal information do we collect?
We may collect the following types of personal information:
- name;
- mailing or street address;
- email address;
- telephone number and other contact details;
- age or date of birth;
- credit card information;
- where relevant, credit and financial information, including commercial credit information and, where applicable, credit-related personal information described in Part B;
- your device ID, device type, geo-location information, computer and connection information, statistics on page views, traffic to and from the sites, ad data, IP address and standard web log information;
- your network usage, for example information about the operation of the equipment, services and applications you use with our Products on the relevant carriers' network;
- usage logs, communications content and recordings if included and enabled as part of a Product;
- details of the Products we have provided to you or that you have enquired about, including any additional information necessary to deliver those Products and respond to your enquiries;
- any additional information relating to you that you provide to us directly through our website or app or indirectly through your use of our website or app or online presence or through other websites or accounts from which you permit us to collect information;
- information you provide to us through customer surveys; or
- any other personal information that may be required in order to facilitate your dealings with us.
We may collect these types of personal information either directly from you, or from third parties. We may collect this information when you:
- register on our website or app;
- communicate with us through correspondence, chats, email, or when you share information with us from other social applications, services or websites;
- interact with our sites, Products, content and advertising;
- invest in our business or enquire as to a potential purchase in our business; or
- apply for, or hold, a commercial credit account with us, including where you are a director or sole trader associated with an application for commercial credit.
In addition, when you apply for a job or position with us we may collect certain information from you (including your name, contact details, working history and relevant records checks) from any recruitment consultant, your previous employers and others who may be able to provide information to us to assist in our decision on whether or not to make you an offer of employment or engage you under a contract. This Part A does not apply to acts and practices in relation to employee records of our current and former employees, which are exempt from the Privacy Act.
2. Why do we collect, hold, use and disclose personal information?
We may collect, hold, use and disclose your personal information for the following purposes:
- to enable you to access and use our website and Products;
- for the activation, management, support and billing of our Products;
- to operate, protect, improve and optimise our website and Products, business and our users' experience, such as to perform analytics, conduct research and for advertising and marketing;
- to send you service, support and administrative messages, reminders, technical notices, updates, security alerts, and information requested by you;
- to send you marketing and promotional messages and other information that may be of interest to you, including information sent by, or on behalf of, our business partners that we think you may find interesting;
- to administer rewards, surveys, contests, or other promotional activities or events sponsored or managed by us or our business partners;
- to comply with our legal obligations, resolve any disputes that we may have with any of our users, and enforce our agreements with third parties;
- to consider your employment application; and
- to assess applications for commercial credit, assess and monitor creditworthiness, determine or review credit limits, administer commercial credit accounts and recover overdue amounts.
We may also disclose your personal information to a trusted third party who also holds other information about you. This third party may combine that information in order to enable it and us to develop anonymised consumer insights so that we can better understand your preferences and interests, personalise your experience and enhance the Products that you receive.
3. Do we use your personal information for direct marketing?
By agreeing to the terms of this Part A, you agree that we and/or our carefully selected business partners may send you direct marketing communications and information about our Products. This may take the form of emails, SMS, mail or other forms of communication, in accordance with the Spam Act 2003 (Cth) and the Privacy Act. You may opt-out of receiving marketing materials from us by contacting us using the details in section 14 or by using the opt-out facilities provided (eg an unsubscribe link).
4. Who we may disclose your personal information to
We may work with other companies that help us provide our systems and services to our customers. We may provide personal information to these companies for the purpose of providing the Products to you and to facilitate our interests as stated above. Those service providers will only be provided with access to your personal information as is reasonably necessary for the purpose that we have engaged the service provider, and we will require that such third parties comply with our standards and all applicable laws.
We may disclose personal information for the purposes described in this Part A to:
- our employees, contractors and related entities;
- third party suppliers and service providers (including providers for the operation of our websites and/or our business or in connection with providing our Products to you);
- the relevant carrier or network provider;
- marketing or advertising providers;
- IT service providers, data storage, web-hosting and server providers;
- professional advisors, dealers, agents, auditors, business brokers, our insurers and insurance brokers;
- payment systems operators (eg merchants receiving card payments);
- our existing or potential agents, business partners or partners;
- our sponsors or promoters of any competition that we conduct;
- anyone to whom our assets or businesses (or any part of them) are, or may (in good faith) be transferred;
- specific third parties authorised by you to receive information held by us;
- courts, tribunals, governmental agencies, regulatory authorities and law enforcement agencies, or as required, authorised or permitted by law;
- any other third parties as required or permitted by law, such as where we receive a summons; and
- credit reporting bodies, trade referees, other credit providers, debt collection agencies and credit management service providers.
5. Disclosure of personal information outside Australia
We may disclose personal information, including credit information and credit eligibility information described in Part B, outside of Australia to our cloud hosting, IT and software providers, content delivery and website security providers, and advertising, analytics and website tagging providers, located in the United States, Singapore, the European Union and other countries in which our service providers operate from time to time.
When you provide your personal information to us, you consent to the disclosure of your information outside of Australia and acknowledge that we are not required to ensure, and cannot guarantee, that overseas recipients will handle that personal information in compliance with Australian Privacy Law. We will, however, take reasonable steps to require that any overseas recipient deals with such personal information in a way that is consistent with the Australian Privacy Principles.
6. Using our website and cookies
We may collect personal information about you when you use and access our website. While we do not use browsing information to identify you personally, we may record certain information about your use of our website, such as which pages you visit, the time and date of your visit and the internet protocol address assigned to your computer.
We may also use 'cookies' or other similar tracking technologies on our website that help us track your website usage and remember your preferences. Cookies are small files that store information on your computer, TV, mobile phone or other device. They enable the entity that put the cookie on your device to recognise you across different websites, services, devices and/or browsing sessions. You can disable cookies through your internet browser but our websites may not work as intended for you if you do so.
We may also use cookies to enable us to collect data that may include personal information. For example, where a cookie is linked to your account, it will be considered personal information under the Privacy Act. We will handle any personal information collected by cookies in the same way that we handle all other personal information as described in this Part A.
7. Security
We may hold your personal information in either electronic or hard copy form. We take reasonable steps to protect your personal information from misuse, interference and loss, as well as unauthorised access, modification or disclosure and we use a number of physical, administrative, personnel and technical safeguards to protect your personal information. For example, we use secure cloud hosting, encryption of data in transit and access controls designed to protect personal information. However, we cannot guarantee the security of your personal information.
8. Links
Our website may contain links to websites operated by third parties. Those links are provided for convenience and may not remain current or be maintained. Unless expressly stated otherwise, we are not responsible for the privacy practices of, or any content on, those linked websites, and have no control over or rights in those linked websites. The privacy policies that apply to those other websites may differ substantially from our Privacy Policy, so we encourage individuals to read them before using those websites.
9. Use of Logos and Testimonials
By agreeing to the terms of this Part A, you grant us a non-exclusive, royalty-free licence to use your business logo and/or testimonials for the purpose of showcasing you as a customer in website content, marketing materials, case studies, proposals, and on our social media platforms.
If at any time you would prefer that your logo and/or testimonial not be used in this way, please contact us via the details in section 14 and we will promptly remove the relevant material.
10. Data retention
We will only retain your personal information for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal information for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.
11. Unsubscribe
To unsubscribe from our e-mail database or opt-out of communications (including marketing communications), please contact us using the details set out in section 14 or opt-out using the opt-out facilities provided in the communication.
12. Accessing or correcting your personal information
You may have the right to ask for your personal information by requesting:
- a copy of your personal information;
- that we correct inaccuracies relating to your personal information;
- that your personal information be deleted or that we restrict access to it; and
- a structured electronic version of your personal information.
You may also have the right to object to our use of your personal information.
Sometimes, we may not be able to provide you with access to all of your personal information and, where this is the case, we will tell you why. We may also need to verify your identity when you request your personal information.
If you think that any personal information we hold about you is inaccurate, please contact us and we will take reasonable steps to ensure that it is corrected.
13. Enquiries or Complaints
You can make enquiries or complaints regarding this Part A or the personal information we hold on you by contacting us using the details in section 14. Please include your name, email address and/or telephone number and clearly describe your request. We will acknowledge your request and respond to you within a reasonable period of time. If you think that we have failed to resolve your request satisfactorily, we will provide you with information about the further steps you can take.
Part B - Credit Reporting Policy
B1. About this Part
This Part B applies where we collect, hold, use or disclose credit information, credit eligibility information or other credit reporting information about you under Part IIIA of the Privacy Act 1988 (Cth) (Privacy Act) and the Privacy (Credit Reporting) Code 2025 (CR Code). If there is any inconsistency between Part A and this Part B in relation to credit information, credit eligibility information or credit reporting information, this Part B applies to the extent of the inconsistency.
In this Part B, credit information, credit eligibility information, CP derived information, repayment history information, default information, commercial credit, consumer credit and credit reporting body have the meanings given to those terms in the Privacy Act.
B2. Kinds of credit information we collect and hold
Where this Part B applies, we may collect and hold the following kinds of information about you:
- identification information, such as your name, date of birth, address, previous addresses and employer;
- credit liability information, including the type of commercial or consumer credit you hold, its terms and credit limit;
- repayment history information, being whether you have made a payment under a credit facility by the date it was due;
- default information, being amounts you owe that are overdue;
- payment and new arrangement information, including whether a default has since been paid or a new payment arrangement made;
- court proceedings information and publicly available information, including judgments and personal insolvency information;
- information that you have committed a serious credit infringement;
- the fact that we, or another credit provider, have made an enquiry to a credit reporting body about your credit worthiness; and
- credit eligibility information (being credit reporting information disclosed to us by a credit reporting body, and information we derive from it), including any risk assessment score or other information that we usually derive from that information (CP derived information).
We collect this information directly from you, and from credit reporting bodies, other credit providers, your representatives and publicly available sources such as court and insolvency registers. We generally hold this information electronically and may also hold it in hard copy. We take the security measures described in Part A to protect the information we hold.
B3. Why we collect, hold, use and disclose this information
Where this Part B applies, we may collect, hold, use and disclose the information described in section B2 to assess an application for credit made by you as a sole trader, or by a company of which you are a director, to verify your identity, to assess your creditworthiness in connection with that application, to determine or review credit limits, to manage and administer any credit we provide (including collecting overdue payments and dealing with defaults), to obtain and use credit reporting information as permitted under Part IIIA of the Privacy Act, and to comply with our obligations under the Privacy Act, the CR Code and other applicable laws.
B4. Credit reporting bodies
We may provide personal information to, and obtain credit reporting information about you from, the following credit reporting body for the purposes described in section B3:

We will obtain any consent required by law for a credit reporting body to disclose credit reporting information about you to us.
A credit reporting body may include information about our credit enquiry on your credit report, including in reports provided to other credit providers to assist them to assess your creditworthiness. The credit enquiry may be used by a credit reporting body or other credit provider to assess your creditworthiness, including to calculate a credit score or credit rating, and may affect your credit score or credit rating.
You can obtain information about how to access or correct credit-related personal information, or make a complaint, in this Part B and in the credit reporting body's credit reporting policy available on its website.
You may also ask a credit reporting body not to use your credit reporting information for the purposes of pre-screening direct marketing, or not to use or disclose your credit reporting information if you reasonably believe that you have been, or are likely to be, a victim of fraud.
If an individual fails to meet their payment obligations in relation to consumer credit or commits a serious credit infringement, a credit provider may be entitled to disclose that information to a credit reporting body. Halytech does not currently provide consumer credit or make those disclosures in relation to consumer credit.
B5. Accessing your credit eligibility information
You may ask us for access to any credit eligibility information about you that we hold. We will respond to your request within a reasonable period and, unless unusual circumstances apply, within 30 days. We may need to verify your identity before giving you access, and any charge we make for giving access will not be excessive. There are limited circumstances in which we may refuse access, in which case we will give you written reasons for the refusal. We will not charge you for making an access request.
B6. Correcting your credit information or credit eligibility information
If you consider that credit information or credit eligibility information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, you may ask us to correct it by contacting us using the details in section 14. If we agree, we will correct the information within 30 days of your request or such longer period as you agree in writing, and take reasonable steps to notify any credit reporting body or other credit provider to which we have disclosed it. If we do not agree to correct the information, we will give you our reasons and information about how you can make a complaint if you disagree.
B7. Credit reporting complaints
You can complain about how we have handled your credit information, credit eligibility information or CP derived information, or about a breach of Part IIIA of the Privacy Act or the CR Code, by contacting us using the details in section 14.
We will acknowledge your complaint in writing within 7 days and explain how we will deal with it. We will investigate your complaint and, where necessary, may consult with a credit reporting body or another credit provider.
We will make a decision and provide you with a written response within 30 days of receiving your complaint, unless you agree in writing to a longer period.
If you are not satisfied with our response, you may make a complaint to the Office of the Australian Information Commissioner.
B8. Retaining and destroying credit reporting information
We will only retain credit information, credit eligibility information and CP derived information for as long as permitted or required under Part IIIA of the Privacy Act, the CR Code and any other applicable law, and will otherwise take reasonable steps to destroy or permanently de-identify it once the applicable retention period ends, unless we are otherwise required or permitted by law to retain it.
B9. Overseas disclosure
Our practices in relation to the overseas disclosure of credit information and credit eligibility information are set out in section 5 of Part A.
